What is Cerebral Palsy Birth Injury Malpractice?
Cerebral Palsy is a neurological disorder that appears in infancy or early childhood and affects body movement and muscle coordination but doesn’t worsen over time. Even though cerebral palsy (CP) affects muscle movement, it isn’t caused by problems in the muscles or nerves. It is caused by abnormalities in areas of the brain that control infant-child muscle movements.
Newborn birth injury CP is generally due to fetal oxygen loss during hospital labor and delivery. A small number of children have cerebral palsy as the result of brain damage occurring in the first few months or years of life, brain infections such as bacterial meningitis or viral encephalitis, or head injury from a motor vehicle accident, a fall down, or by infant, baby or child abuse.
Asphyxia or insufficient brain oxygen, is a factor in cerebral palsy. Loss of oxygen in the infant before or during birth delivery is caused by events including maternal low blood pressure (hypotension), rupture of the umbilical cord, uterine rupture, cardiac complications, childbirth hemorrhage (blood loss), and trauma. Severe and prolonged loss of oxygen (severe hypoxia) to the newborn during delivery can cause brain damage injury and physical or cognitive difficulties.
Most children with Cerebral Palsy are born with it, although sometimes detected years later. Early symptoms of cerebral palsy usually appear before a child is 3 years old. Signs are lack of muscle coordination for voluntary movements (ataxia); exaggerated reflexes (spastic); walking with foot or leg dragging, or on toes, or a crouched or scissor gait; and muscle tone too stiff or floppy.
What is Erb's Palsy Birth Injury Medical Malpractice?
Brachial plexus nerve injuries can occur during a difficult labor and delivery. For example, it can occur if the infant's head and neck are pulled toward the side as the shoulders pass through the birth canal, i.e. the vagina. The condition can be caused by excessive pulling on the shoulders during a head first birthing or by pressure on the raised arms during a breech (feet first) birthing.
There are different forms of Erbs (Duchenne) brachial palsy upper limb (arm) birthing-childbirth injury in infants. The limb palsy type depends on the degree of arm paralysis:
